Introduction

This document constitutes the Terms of Service ("Agreement") governing the use of products, software, services, and websites (collectively, "Services") provided by The Maximalist ("Company", "we", "us", or "our"), and other related applications and open-source projects. By accessing or using any of the Services, you ("User", "you", or "your") agree to be bound by this Agreement. If you do not agree to this Agreement, you are not authorized to use any of the Services.

1. Use of Services

1.1 General Terms: This Agreement applies to all Services provided by the Company. Some Services may have their own terms and conditions that apply in addition to this Agreement. Where applicable, these specific terms will be made available with the relevant Services.

1.2 Open Source Projects: The Company's open-source projects are licensed under terms that may include, but are not limited to, the MIT License. Use of such projects is subject to the terms of the respective licenses.

2. User Contributions

2.1 Contributions to Open Source Projects: Users may contribute to the Company's open-source projects through GitHub or by sending pull requests to the specified Company email address. By making a contribution, you represent and warrant that your contribution does not infringe on the intellectual property rights of third parties and agree to license your contributions under the same terms as the underlying project.

3. Intellectual Property

3.1 Rights Reserved: All rights not expressly granted to users in this Agreement are reserved by the Company. The Company's brand names, trademarks, and service marks may not be used in connection with any product or service without the prior written consent of the Company.

4. Warranty Disclaimer

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SERVICES OR THE USE OR OTHER DEALINGS IN THE SERVICES.

5. Modifications to the Agreement

The Company reserves the right, at its sole discretion, to modify or replace this Agreement at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

6. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the United States, without giving effect to any principles of conflicts of law.

7. Dispute Resolution

Any disputes arising out of or related to this Agreement or the use of the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
